Income Benefits & Medical Care
If You Have A Georgia Workers' Compensation Case, Are You Receiving All The Benefits You Deserve?
We find when clients come to us for representation in a workers' compensation claim, the answer is no. While Mr. Clay has written extensively about the workers' compensation system which can be found by visiting Georgia Law Blog, we want you to understand the basic benefits to which you were entitled. If you have Georgia worker's compensation case, you are eligible to receive weekly income benefits, called temporary total disability benefits, if you have been out of work for seven days or more. Although payment is not due until 21 days after you injury, you should receive all the past due benefits since the date of your injury. If you return to work, you will be eligible for a modified type of weekly income benefits. These benefits are often referred to as temporary partial disability benefits. If you have missed work due to your on the job injury, you should receive two-thirds of the difference between what you made after being hurt compared to what you made prior to the injury, up to the statutory maximum.
Am I Stuck With The Company Doctor? What About Pain & Suffering?
Medical care is another important aspect. When clients come to our office, we often find that they are not receiving adequate medical care. In most cases, you are obligated to treat with the company doctor only if a Panel of Physicians was properly posted at work. It is our experience that many employers do not have a Panel of Physicians posted at the job site. We have been successful in getting out clients treated by the doctor of their choice instead of the company doctor. Many clients also ask us about pain and suffering. Unfortunately, pain and suffering is not a component of the workers' compensation system in Georgia. However, at a certain point after you are injured, you should reach maximum medical improvement. At this point, a permanent partial disability rating can be assigned and compensation can be paid to you for the degree of your disability.
If you or a loved one has been injured in a work accident in Atlanta, GA, or anywhere throughout Georgia, please contact our office for a free, no obligation, and confidential legal consultation.
